EXECUTIVE SUMMARY:
The applicant was discharged for Misconduct due to Commission of a Serious Offense in 2012. The
applicant’s complete Personnel Data Record and Separation Package were available for the Board to review.
The Board finds no issues with propriety or equity in this case. The applicant pled guilty to Assault and False
Official Statements at a Summary Court Martial prior to discharge.
The applicant was notified of the intent to discharge, and the applicant was advised of his rights to an attorney,
he made a statement on his behalf and objected to discharge. The applicant was also denied a Second Chance
waiver by the District Admiral due to the laundry list of offenses in a short time period. No new evidence has
been provided by the applicant on his board request.
RECOMMENDATION: The Board members thoroughly reviewed the applicant’s record of service and all
available documentation*. The Board deemed that the applicant’s character of service, reason for separation
and reenlistment code are appropriate and should not be changed. The applicant has not substantiated any error
